Preamble

These General Terms and Conditions of Sale (hereinafter "GTC") apply to all sales concluded on the Decléor website, accessible at https://decleor.com (hereinafter "the Site").

The Site sells cosmetic and aromatherapy care products from the Decléor brand.

By placing an order on the Site, the customer acknowledges having read these Terms and Conditions and accepts them without reservation.


Article 1 — Purpose and scope

These General Terms and Conditions define the rights and obligations of the parties in the context of the online sale of products offered on the Site.

These terms and conditions apply to all orders placed by consumers (hereinafter "the Customer") residing in mainland France and Corsica. For deliveries to French overseas departments and territories or abroad, please contact us for a personalized quote.

COSPAL reserves the right to modify these Terms and Conditions at any time. The applicable terms and conditions are those in effect on the date the order is validated.


Article 2 — Products

The products offered for sale are those presented on the Site, subject to available stock.

Each product is accompanied by a detailed description. Photographs illustrating the products are not contractually binding. In the event of a clear discrepancy between the product's characteristics and its representation, COSPAL cannot be held liable.


Article 3 — Price

Product prices are shown in euros, inclusive of all taxes (TTC), excluding delivery charges.

Delivery charges are indicated before final order confirmation and are billed in addition to the price of the products.

COSPAL reserves the right to change its prices at any time. Products are billed based on the rates in effect at the time the order is validated.

In the event of the creation or modification of taxes or contributions, these may be passed on to the selling price of the products.


Article 4 — Order

4.1 Placing an order

To place an order, the Customer selects the products of their choice and adds them to their basket. They then access their basket to check the details of their order and its total amount.

The Customer enters their delivery and billing details, chooses their delivery method, and then proceeds to payment.

The order is only definitively validated after payment confirmation. A confirmation email summarizing the order is then sent to the Customer.

4.2 Modification and cancellation

Any request for modification or cancellation must be sent as soon as possible to contact@cospal.fr. COSPAL will make every effort to respond, but cannot guarantee this if the order has already been shipped.

4.3 Order Refusal

COSPAL reserves the right to refuse or cancel any order in the event of:

  • Dispute concerning payment for a previous order
  • Legitimate reason, particularly in the event of suspicion of fraud


Article 5 — Payment

5.1 Payment methods

Orders are paid for by credit card (Visa, Mastercard, American Express) via a secure payment platform.

The total amount of the order is debited at the time of validation.

5.2 Payment Security

Transactions are secured by our payment provider. COSPAL never has access to the Client's full bank details.

Article 6 — Delivery

6.1 Delivery Zones and Times

Deliveries are made in mainland France and Corsica.

Delivery times are indicated during the ordering process and begin from the date of payment confirmation. For informational purposes only:

  • Standard delivery : 3 to 5 business days
  • Express delivery : 24 to 48 hours

These delivery times are indicative only and may vary depending on product availability and the carrier.

6.2 Order Receipt

The Customer agrees to check the condition of the package upon receipt. In case of any anomaly (damaged package, missing or damaged product), the Customer must:

  • Note any reservations in writing on the delivery slip
  • Refuse the package if necessary
  • Notify COSPAL within 48 hours by email to contact@cospal.fr

6.3 Absence at the time of delivery

If you are not home, a delivery notice will be left allowing you to collect the package according to the carrier's terms and conditions.

Any package returned due to an incorrect address or unclaimed item will be reshipped at the customer's expense.


Article 7 — Right of withdrawal

In accordance with Articles L.221-18 et seq. of the Consumer Code, the Customer has a period of 14 days from receipt of his order to exercise his right of withdrawal, without having to justify reasons or pay penalties.

7.2 Product Returns

Products must be returned in their original condition and packaging, complete and unused, within 14 days of notification of withdrawal.

Return shipping costs are the responsibility of the Customer, except in the case of an error by COSPAL.

7.3 Reimbursement

COSPAL will issue a refund within 14 days of receiving the returned products or proof of shipment, whichever comes first.

The refund is issued via the same payment method used for the order.

7.4 Exclusions

The right of withdrawal cannot be exercised for products unsealed after delivery and which cannot be returned for reasons of hygiene or health protection (Article L.221-28 of the Consumer Code).

Article 9 — Legal Guarantees

All products sold on the Site are covered by the legal guarantees provided for in the Consumer Code:

9.1 Guarantee of conformity (articles L.217-4 to L.217-14)

The Customer may request repair or replacement of the non-conforming product. If these solutions are impossible, the Customer may return the product and obtain a full or partial refund.

9.2 Warranty against hidden defects (Articles 1641 to 1649 of the Civil Code)

The Customer may choose between rescinding the sale or a price reduction if the product has a hidden defect rendering it unfit for use.

Article 11 — Mediation

In accordance with the provisions of the Consumer Code relating to the amicable settlement of disputes, the Customer may use the free mediation service offered by COSPAL.

Before contacting the mediator, the Client must have first attempted to resolve their dispute directly with COSPAL through a written complaint.

Article 12 — Personal Data

12.1 Data Controller

COSPAL, as the data controller, collects and processes the Client's personal data.

12.2 Data collected

  • Identification data: name, surname, email address, postal address, telephone number
  • Connection data: IP address, browsing data
  • Transaction data: order history, payment data

12.3 Purposes of the processing

  • Order and customer relationship management

12.4 Legal basis

The processing is based on the performance of the contract, the Client's consent or COSPAL's legitimate interest.

12.5 Recipients

Data may be transmitted to COSPAL's service providers (logistics, payment, hosting) strictly within the framework of the execution of services.

12.6 Conservation

Data is kept for the duration of the business relationship and for up to 3 years after the last contact, unless there is a legal obligation to keep it for a longer period.

In accordance with the GDPR and the French Data Protection Act, the Client has the following rights:

Article 13 — Cookies

Article 14 — Intellectual Property

All elements of the Site (texts, images, logos, trademarks, etc.) are protected by intellectual property law.

Any unauthorized reproduction, representation or exploitation is prohibited and constitutes an infringement punishable by law.


Article 15 — Force majeure

COSPAL cannot be held responsible for the non-performance of its obligations in the event of force majeure, as defined by Article 1218 of the Civil Code and French case law.

Cases of force majeure include: natural disasters, strikes, pandemics, transport blockages, and interruptions of telecommunications networks.


Article 16 — General Provisions

16.1 Entirety

These General Terms and Conditions express the entirety of the obligations of the parties.

16.2 Partial Nullity

If a clause of the General Terms and Conditions is declared null and void, the other clauses remain fully valid.

16.3 Non-waiver

COSPAL's failure to invoke a breach by the Client does not constitute a waiver of its right to invoke it subsequently.


Article 17 — Applicable Law and Jurisdiction

These Terms and Conditions are governed by French law.

In the event of a dispute, an amicable solution will be sought prior to any legal action.

In the absence of an amicable agreement, the French courts shall have sole jurisdiction.
